Strasbourg judgment (6 December 2012) Michaud v. France

Two weeks ago, the European Court of human rights delivered a judgment in the case of Michaud v. France. Even though it is not final yet, this judgment is highly interesting because of its dual core,  giving better shape to the Bosphorus doctrine while reaching questionable conclusions on the nature of national law’s “foreseeability” test.
