TELEPHONE TAPPING  

The cases of Niculescu v. Romania and Valentino Acatrinei v. Romania concern criminal proceedings brought against a former lawyer and judge for corruption as a result of telephone tapping by the Romanian Intelligence Service. Both applicants complain that the criminal proceedings brought against them were unfair and allege that the telephone tapping of their conversations used as evidence to convict them was illegal. The Court found a violation of Article 8 in respect of both applicants. It ruled before that the system in place in Romania for telephone tapping on grounds of national security lacked proper safeguards and thus breached the requirements of Article 8.

DISABLED CHILDREN

No this is not a pretty picture and it gets really bad. In the case of Nencheva and Others v. Bulgaria, the European Court of Human Rights held, unanimously, that there had been a violation of Article 2 (right to life) of the European Convention on Human Rights. Fifteen children and young adults died between 15 December 1996 and 14 March 1997 in a home for physically and mentally disabled young people in the village of Dzhurkovo, from the effects of cold and shortages of food, medicines and basic necessities. The manager of the home, observing the problems, had tried without success on several occasions to alert all the public institutions which had direct responsibility for funding the home and which could have been expected to act.

Tuesday the European Court of Human Rights (ECtHR) and the European Union Agency for Fundamental Rights (FRA) launched a second practical guide to European law. The Handbook on European law relating to asylum, borders and immigration is the first comprehensive guide to European law in the areas of asylum, borders and immigration, taking into account both the case-law of the ECtHR and that of the Court of Justice of the European Union (CJEU). It also contains the relevant EU Regulations and Directives, as well as references to the European Social Charter (ESC) and other Council of Europe instruments. You can download the handbook here.

Is a credit institution, established in one Member State of the European Union and operating in another Member State of the European Union, as provided for in Title III of  Directive 2000/12/EC (credit institutions) under the rules on the freedom to provide services, obligated under national legislation of that host Member State to disclose information required for the purpose of combating money laundering directly to the FIU of that host Member State?
